The Delta woman convicted of impaired driving causing death in the crash that killed four-year-old Alexa Middelaer will remain out on bail until her appeal hearing in November.

The B.C. Court of Appeal on Thursday set Nov. 10 as the date for the conviction appeal of Carol Berner, who was found guilty of impaired driving causing death and bodily harm, and dangerous driving causing death and bodily harm in the 2008 crash that killed the little girl and seriously injured her aunt Daphne Johanson.

Berner is appealing her conviction and jail sentence of 30 months in jail. She was released on bail last November pending the result of the appeal.

The court also agreed to extend her bail until the November hearing.
