Delta sues farm over alleged damage to Burns Bog

The Corporation of Delta and Metro Vancouver last week launched a civil suit against a local farm alleging damage to Burns Bog due to soil deposits. The suit launched in B.C.

The Corporation of Delta and Metro Vancouver last week launched a civil suit against a local farm alleging damage to Burns Bog due to soil deposits.

The suit launched in B.C. Supreme Court against Princess Farms, Matcon Landfill Management and Matcon Civil Constructors alleges that damage to Burns Bog was caused by soil deposit activities that were carried out on the adjacent Princess Farms property.

The suit alleges that the soil deposits were carried out by, or under the supervision of, Matcon Landfill Management Inc. or Matcon Civil Constructors Inc., contrary to the terms of an approval issued by the Agricultural Land Commission, which required that the fill not be placed in an area near the bog.

The Corporation alleges that 17,000 square feet of Burns Bog, including vegetation, trees, wildlife habitat and the peat bog itself, has been affected by soil depositing. The alleged damage includes, tearing, heaving and the vertical and lateral displacement of the peat bog near where fill was placed on native peat on the adjacent farm land. Run off from the fill may also affect the bog’s chemistry, the suit alleges.
